Plaintiffs allege NYPD's unlawful detention and excessive force

A lawsuit has been filed against the City of New York, alleging civil rights violations by its police officers. On October 4, 2024, Siera Daniels, Ariel Mitchell, and Jabriel Mitchell filed a complaint in the United States District Court for the Eastern District of New York against the City of New York and unnamed police officers referred to as John and Jane Doe.

The plaintiffs claim that on July 8, 2023, they were unlawfully detained and subjected to excessive force by NYPD officers near 345 Thatford Avenue in Brooklyn. According to the complaint, Jabriel Mitchell was approached by two officers who ordered him to move despite not engaging in any improper activity. After complying with their request, he was allegedly arrested without probable cause and subjected to physical aggression. Ariel Mitchell and Siera Daniels faced similar treatment when officers demanded identification from Ariel without justification and subsequently arrested him while detaining Siera without cause. The charges against Ariel and Jabriel were later dismissed on July 27, 2023.

The plaintiffs argue that these actions were part of a broader pattern of unconstitutional practices by the NYPD, including improper stop-and-frisk tactics. They accuse the City of New York of failing to adequately train and supervise its officers, leading to repeated civil rights violations. The complaint seeks compensatory damages for emotional distress and deprivation of liberty, punitive damages against individual defendants, attorneys' fees, and other relief deemed appropriate by the court.
