Plaintiff alleges airline negligence led to in-flight injury

A passenger has filed a lawsuit against JetBlue Airways Corporation, alleging injuries from an in-flight incident. On October 22, Kiara Quinonez filed the complaint in the United States District Court for the Eastern District of New York, focusing on an August 20 incident during a JetBlue international flight from New York to Paris.

The complaint states that Quinonez was served a frozen "chomp size" strawberry shortcake ice cream sandwich, resulting in a root fracture of her tooth number 10, which required medical treatment upon landing and additional care after returning to the United States. Quinonez alleges that this injury was due to JetBlue's negligence and seeks damages under the Montreal Convention, which regulates international air travel.

Quinonez’s legal team argues that JetBlue breached its duty of care by serving food at an unsafe temperature without warning passengers of potential risks. The lawsuit states that JetBlue is strictly liable for Quinonez’s injuries under Article 17 of the Montreal Convention, which assigns liability to carriers for accidents causing bodily harm during flights. Additionally, the complaint alleges negligence on JetBlue's part for insufficient training or supervision of its crew regarding safe food service practices.

Quinonez seeks compensation for medical expenses and damages related to her injuries and demands a jury trial to determine the amount, along with interest and court costs.
