Daughter files lawsuit against healthcare providers alleging medical malpractice led to mother's death

Heidi Fischer, acting as the administrator of her deceased mother Margaret Ann Fischer’s estate, has filed a lawsuit alleging medical malpractice and negligence against several healthcare providers. The complaint was filed on Nov. 8, 2024, in the U.S. District Court for the Eastern District of New York. 

Defendants named in the case include Dr. Marek R. Lupicki, L.P.N. Kiesha Woodley, Nicole Silva, Old Bridge Medical Center, Hackensack Meridian Health, and Venetian Care and Rehabilitation Center.

The case centers on alleged negligent care provided to Margaret Ann Fischer between Nov. 22 and Dec. 15, 2022. According to the complaint filed by Heidi Fischer through her attorneys at Dell & Dean, P.L.L.C., the healthcare providers failed to meet established medical standards in treating Fischer. The plaintiff claims this failure led to severe injuries and ultimately caused Fischer’s death on Dec. 15, 2022.

The lawsuit accuses the defendants of negligence and medical malpractice under New Jersey law. The complaint alleges the defendants did not properly communicate or evaluate Fischer’s medical condition, failed to provide adequate documentation or diagnosis, and did not inform Fischer or her surrogates about her true condition or obtain informed consent for treatments administered.

Additionally, Heidi Fischer claims there was negligent hiring and retention of unqualified medical personnel by the institutions involved. She argues these entities employed individuals who lacked the necessary skills and knowledge compared to other professionals in similar communities.

Heidi Fischer is seeking compensatory damages for the pain and suffering her mother endured before her death. She also requests punitive damages, alleging reckless conduct by those responsible for her mother’s care, as well as attorneys' fees and other related costs.
