Patient Alleges Negligence Against Federal Healthcare Provider Over Cancer Diagnosis

A medical malpractice lawsuit has been filed against the United States of America, alleging negligence in cancer diagnosis and treatment. On August 22, 2024, Sonia Delcid initiated legal action in the United States District Court for the Eastern District of New York, accusing the Department of Health & Human Services and Hudson River Healthcare Inc. of failing to provide timely and adequate medical care.

According to the complaint, Delcid's ordeal began on June 8, 2016, when Dr. Charles R. DeLaCuadra informed her that no further imaging was necessary following a mammogram. However, by September 2016, Delcid discovered a lump in her right breast and scheduled an appointment for October 4, 2016. The examination revealed a firm mass in her breast. An ultrasound performed on November 17, 2016, identified a new speculated mass leading to a biopsy that confirmed infiltrating ductal carcinoma. Despite undergoing chemotherapy and surgery at Stony Brook Medicine between June 2017 and October 28, 2017, Delcid claims that earlier detection could have significantly altered her treatment outcome.

Delcid alleges that Dr. DeLaCuadra's failure to recommend an ultrasound following the initial mammogram constituted negligence and professional malpractice. She asserts that Hudson River Healthcare Inc.'s staff allowed her condition to go undiagnosed due to inadequate training and supervision. "The Defendants breached their duty of care," states the complaint, emphasizing how this oversight caused Delcid significant physical pain and emotional distress.

The plaintiff seeks $1 million in damages for medical expenses, lost wages, pain and suffering, future impairment, and loss of enjoyment of life. Additionally, she requests reimbursement for legal costs incurred during this civil action.
