Lawsuit alleges deceptive labeling by Piping Rock Health Products

A class-action lawsuit has been filed against Piping Rock Health Products, LLC, doing business as Natural Vitality, over allegations of misleading labeling on their "CALM GUMMIES Magnesium Supplement" products. The complaint was filed in the U.S. District Court for the Eastern District of New York on December 6, 2024, by Andrea Greene.

The lawsuit claims that Natural Vitality’s magnesium supplements do not contain the advertised 330 mg of magnesium per serving derived from magnesium citrate. 

Greene, who purchased the supplements in Georgia over the past four years, argues that it is chemically impossible for the gummies to contain such an amount of elemental magnesium due to the low concentration of magnesium in magnesium citrate. 

The lawsuit accuses Natural Vitality of violating federal regulations designed to prevent deceptive supplement labeling and breaching express warranties through fraudulent concealment. It also alleges violations of the Georgia Fair Business Practices Act.

Greene’s legal team argues that consumers have been misled by the product labels, which prominently display incorrect magnesium content. 

They contend that this misinformation constitutes unfair and deceptive business practices under both state and federal law. Greene asserts that reasonable consumers rely on these labels when making purchasing decisions, particularly valuing magnesium derived from citrate over other sources like magnesium oxide, a cheaper alternative with less desirable health benefits.

The plaintiff seeks various forms of relief, including actual damages, restitution, punitive damages, and an injunction against further deceptive practices by Natural Vitality. Greene also requests attorney fees and costs associated with pursuing the legal action.
