Brooklyn man sues NYPD officers and city for alleged brutal assault, malicious prosecution during family gathering

A Brooklyn resident has filed a lawsuit against the City of New York and several police officers, alleging brutal assault and malicious prosecution.

The lawsuit filed by plaintiff Shaquan Davis accuses Officers Murad Pashayev, Sean Mahoney, Fausto V. Moisessantos, Sgt. Nicholas M. Occhipinti, and others of excessive force and false charges. The incident allegedly occurred on July 4, 2024, when Davis was celebrating Independence Day with his family in Brooklyn. According to the complaint, Davis witnessed the defendants pushing individuals and throwing his girlfriend's sister to the ground. Concerned about their conduct, he questioned Officer Pashayev about their actions. This inquiry allegedly led to an unprovoked attack by Pashayev and other officers who punched him repeatedly in the face and body without any lawful justification. The assault resulted in significant injuries to Davis's shoulder and face, as well as lasting emotional distress.

Following the alleged beating, Davis was arrested on what he claims were false charges fabricated by the officers to cover up their misconduct. These charges were later dismissed in court. The lawsuit details a pattern of complaints against the involved officers—Pashayev with seventeen complaints over two years, Occhipinti with eighteen complaints, and Mahoney with thirteen, all allegedly resolved without thorough investigation or consequence.

Davis is seeking compensatory damages for personal injuries and emotional distress resulting from this incident. He also demands punitive damages against individual officers where permissible by law, interest on damages awarded, attorney’s fees, costs of litigation, and a declaration that his rights were violated.

The plaintiffi is represented by attorneys Aymen A. Aboushi and Tahanie A. Aboushi of the Aboushi Law Firm PLLC. The case was filed in the United States District Court for the Eastern District of New York under Civil Case No. 1:25-cv-02047.
