A woman has filed a class action lawsuit against the makers of Orville Redenbacher’s Naturals Popcorn products, claiming that the company deceptively markets its products as containing "only real ingredients" and being "natural," despite the presence of synthetic ingredients like mixed tocopherols.
According to the complaint filed by plaintiff Julia Gibson, Conagra Brands markets and sells various flavors of Orville Redenbacher’s Naturals Popcorn across the United States, including New York. The plaintiff claims that she purchased these products because they were marketed as natural and free from synthetic additives. She argues that these representations are false because the products contain mixed tocopherols, which are synthetic ingredients used as preservatives. She adds that had she known about the synthetic ingredients, she would not have bought them or would have paid less.
The lawsuit accuses Conagra Brands of violating New York General Business Law §§ 349 and 350 by engaging in deceptive acts and false advertising. The plaintiff asserts that these actions were intended to exploit consumer preferences for natural foods perceived as healthier and safer. Furthermore, the complaint highlights how health-conscious consumers are willing to pay a premium for products marketed as natural. Despite this premium pricing strategy, the presence of synthetic ingredients contradicts Conagra's advertised claims.
Gibson seeks various forms of relief from the court on behalf of herself and others similarly affected. These include compensatory damages exceeding $5 million for all class members combined, statutory damages under New York law, punitive damages, restitution, and injunctive relief to prevent further misleading marketing practices by Conagra Brands. Additionally, she requests attorney fees and other related costs associated with bringing this lawsuit.
