TD Bank faces class action lawsuit over $3 paper statement fee

A federal class action lawsuit has been filed against TD Bank, N.A., alleging that the bank unlawfully charged customers fees for receiving paper billing statements, in violation of New York General Business Law § 399-zzz.

The complaint, filed by plaintiff Joshua Hastings, focuses on a $3 monthly fee TD Bank charges customers who receive account statements by mail. The lawsuit contends that this fee violates New York law, which prohibits charging additional fees for paper billing statements.

According to the complaint, paper statements serve as important documentation for consumers to track transactions and identify errors or unauthorized activity. Hastings, a TD Bank checking account holder since at least 2024, alleges that he was charged the $3 fee monthly and that it appeared on his account statements alongside other bank fees.

The complaint argues that the practice impacts individuals who may not have internet access or who prefer mailed statements for privacy or security reasons. Hastings seeks compensatory and statutory damages, restitution, and injunctive relief, and is requesting that the case be certified as a class action to represent other similarly affected customers in New York.

The plaintiff is represented by attorneys Philip L. Fraietta and Julian C. Diamond of Bursor & Fisher, P.A. The case was filed in the U.S. District Court for the Eastern District of New York under Case ID 1:25-cv-02336-HG.
