A consortium of New York-based healthcare facilities has filed a lawsuit against a Texas law firm, alleging a misleading advertising campaign that could harm their reputation.
The lawsuit was initiated by several entities, including Absolut Care and Taconic Rehabilitation & Nursing Centers against Anderson Alexander PLLC. They allege that Anderson Alexander PLLC disseminated Facebook advertisements targeting current and former employees of these facilities. The ads suggest that these employees "may qualify" for unpaid wage claims against the plaintiffs, without factual basis. The plaintiffs contend that these advertisements are deceptive and have caused reputational harm and business disruption.
The complaint states that the plaintiffs comply with all applicable wage-and-hour laws and have not received any regulatory or employee notice suggesting otherwise. They allege that Anderson Alexander's actions imply wrongdoing without evidence. Additionally, they claim that Anderson Alexander's attorneys are not admitted to practice law in New York and have engaged in unauthorized practice by offering legal advice related to New York wage claims.
The lawsuit accuses Anderson Alexander PLLC of violating New York General Business Law § 349, tortious interference with prospective economic advantage, common law unfair competition by misrepresentation, unjust enrichment, and defamation.
The plaintiffs are seeking immediate injunctive relief to stop the advertising campaign and protect their standing in the community. They are pursuing damages of at least $250,000, along with other relief the court may find appropriate. The plaintiffs also request presumed damages, special damages determined at trial but no less than $250,000, and preliminary and permanent injunctive relief to prevent further dissemination of the advertisements. They seek declarations affirming violations of GBL § 349 and the other claims in their complaint.
The plaintiffs are represented by attorney David J. Fryman of Fryman PC. The case was filed in the United States District Court for the Eastern District of New York under Case ID 25-cv-2473 and is presided over by Judge Eric Komitee.
