Plaintiffs allege legal malpractice against former attorneys over missed deadlines

Zomongo.TV USA, Inc., Jeremy Ostrowski, and Jocelyne Hughes-Ostrowski have filed a $21 million legal malpractice lawsuit against Colonna Cohen Law, PLLC and attorney Ashlee Colonna Cohen. 

The complaint, filed on August 12, 2025, in the Southern District of New York, alleges years of negligence that led to missed deadlines, wrongful judgments, and ongoing unauthorized legal representation.

The plaintiffs claim the defendants failed to file timely actions against multiple parties within the statute of limitations, resulting in wrongful judgments totaling millions of dollars. 

They also accuse the defendants of taking adverse actions against their clients after being terminated and violating professional conduct rules by refusing to withdraw as counsel.

The plaintiffs seek treble damages under Judicial Law § 487 for deceptive acts intended to conceal gross malpractice and violations of professional responsibility rules.

Additionally, they request punitive damages for willful misconduct and a declaratory judgment nullifying any fees claimed by the defendants due to termination for cause.

The lawsuit details multiple instances where the defendants allegedly missed critical deadlines or filed incorrect documents, causing significant financial harm. For example, in a case involving GTR Source LLC, the defendants reportedly failed to perfect an appeal due to procedural errors and missed deadlines. In another matter with Capital Advance Services LLC (CAS), they allegedly made false representations about court filings and interfered with settlement negotiations.

Furthermore, the plaintiffs assert that despite terminating Colonna Cohen Law in June 2025, the firm continued to represent them without consent and filed unauthorized appeals. This ongoing representation has led to additional legal battles as the plaintiffs seek to remove the firm from their cases.

The case is being heard under Case ID 1:25-cv-04798-FB-TAM.
