The case centers around a data breach that occurred on or around October 28, 2025, when an unauthorized third party accessed Cohen’s Fashion Optical's systems and obtained files containing personally identifiable information (PII) and protected health information (PHI) of customers. The plaintiff alleges that the retailer was negligent in safeguarding this sensitive data, which was reportedly left unencrypted and vulnerable to cyberattacks. The ransomware group Sinobi has claimed responsibility for the breach, threatening to release the stolen data if negotiations fail.
Sanchez argues that Cohen’s Fashion Optical had a legal duty to protect customer information from unauthorized access but failed to implement adequate security measures.
