Plaintiff (insurance company) accuses Defendant (property owners) of Negligence Leading to Fire Damage

AmGuard Insurance Company has taken legal action against two individuals following a devastating fire that caused significant damage to a property in South Richmond Hill, New York. The complaint was filed by AmGuard Insurance Company on November 18, 2025, in the United States District Court for the Eastern District of New York against Phulmatie Singh and Anand Singh.

The lawsuit stems from an incident on August 29, 2025, when a fire broke out at the property owned by the Singhs at 9536 111th Street. According to the complaint, the fire quickly spread to a neighboring property insured by AmGuard, causing extensive damage. The insurance company claims that the fire resulted from negligent actions by the Singhs, specifically their careless handling of candles and failure to maintain safe conditions at their property. The complaint alleges that "the Defendants negligently, carelessly, recklessly and wantonly used, handled, disposed of and/or failed to properly extinguish a candle or candles," leading to the fire.

AmGuard's investigation revealed that the Singhs' property was maintained under "hoarding-like conditions," which exacerbated the risk of fire. The insurance company argues that the Singhs should have been aware of these conditions and taken appropriate measures to prevent such an incident. As a result of this negligence, AmGuard paid out claims related to fire damages under its policy with Gocool Ramsarat, who owned the affected neighboring property.

The lawsuit seeks damages exceeding $118,474.45 from Phulmatie Singh and Anand Singh for their alleged negligence. AmGuard is pursuing recovery for costs incurred due to the fire damage and is also seeking pre-judgment interest and other relief deemed appropriate by the court. The insurance company has demanded a jury trial for this case.
