Plaintiff Alleges Medical Malpractice Against NYU Langone Hospital-Brooklyn

A New York resident has filed a significant medical malpractice lawsuit against a group of healthcare professionals and a major hospital, alleging negligence and lack of informed consent. The complaint was lodged by Stefany C. Rodriguez Valdez on October 20, 2023, in the Supreme Court of the State of New York, County of Kings, targeting NYU Langone Hospital-Brooklyn and several associated doctors.

According to the lawsuit, from June 8 to June 12, 2021, Stefany C. Rodriguez Valdez sought medical care at NYU Langone Hospital-Brooklyn for severe back pain, chest pain, epigastric pain, frequent vomiting, labor and delivery issues requiring a cesarean section, and post-operative care. The defendants named in the case include Drs. George C. Aglialoro, John F. Heitner, Andrew Sackrison, Vuy San Li, Susan H. Cheng, Shilpi Mehta-Lee, and Meleen Chuang—all affiliated with NYU Langone Hospital-Brooklyn either as employees or independent contractors.

The plaintiff accuses these medical professionals and the hospital of failing to meet accepted standards of medical practice during her treatment. She claims that their negligence led to a delay in diagnosing an aortic dissection—a serious condition that resulted in further complications such as visceral ischemia and acute mesenteric ischemia among others. "Defendants failed to treat and care for Plaintiff in accordance with the standards of care generally accepted in the community," states the complaint.

Rodriguez Valdez is seeking compensation for significant injuries she sustained due to this alleged negligence. These injuries reportedly include cardiomyopathy, abscesses, sepsis leading to respiratory failure requiring surgical interventions like ileostomy and bowel resection. Furthermore, she asserts that there was a lack of informed consent regarding her treatment options which contributed to her adverse outcomes.

The lawsuit also includes allegations against NYU Langone Hospital-Brooklyn for negligent hiring and retention practices concerning its healthcare staff. The plaintiff contends that the hospital failed to ensure its physicians possessed adequate skills necessary for proper patient care.

Stefany C. Rodriguez Valdez is represented by Walter Osuna from The Jacob D. Fuchsberg Law Firm based in New York City. She seeks judgment exceeding the jurisdictional limits of lower courts along with costs related to her legal action against all defendants involved: Drs. Aglialoro; Heitner; Sackrison; Li; Cheng; Mehta-Lee; Chuang; and NYU Langone Hospital-Brooklyn under three causes—medical malpractice; lack of informed consent; negligent hiring/retention practices.

The case is being heard under Index No: 530481/2023 before judges at Kings County Supreme Court where both sides will present their arguments regarding these serious allegations involving one individual’s pursuit for justice following what she claims was substandard medical treatment resulting in life-altering consequences.
